Terms of Use

These terms govern your use of Astern — the website at astern.dev and our mobile apps. By creating an account you agree to what is below. If you do not agree, please do not use Astern.

Astern is owned and operated by KENY ENTERPRISES LLC, a New York limited liability company trading as Keny Labs. Where these terms say “we” or “Astern”, that is who you are agreeing with.

1. What Astern does

You give us a page on a website you control and the countries you want visitors from. We buy advertising on platforms such as Google, Microsoft, Meta and Reddit, under our own accounts and at our own cost, and we send people to that page. Our tracker counts the people who arrive, and you pay a fixed price for each one.

We sell visitors, not outcomes. We do not promise sales, signups, revenue, search rankings, or any particular result once someone reaches your page. Any figure we show you before a campaign starts is an estimate based on what advertising costs at that moment, not a commitment.

2. Your account

You must give accurate details and keep them current. You are responsible for anything done through your account and through any private dashboard link we issue you. Those links act as a key: anyone holding one can see your campaigns and spend your credit, so treat a dashboard link as a password and tell us at once if it is shared or lost so we can replace it.

3. The site you send us to

You confirm that you own or are authorised to advertise the website you give us, and that it complies with the law and with the advertising policies of the platforms we buy on. You are responsible for what is on it.

We will not run campaigns for adult content or weapons. Some categories — including healthcare and medicines, financial services, gambling, dating, cryptocurrency, weight loss and political content — need a person to review them first and may need certification from the advertising platform before anything can run. We may decline or stop a campaign at any time if we believe it breaches a platform policy or the law, and we will tell you why.

4. Paying, and what you are charged for

Astern is prepaid. You add credit, and each campaign has a price per visitor and a budget you set. We charge your credit for visitors who arrive, day by day, and never beyond the budget you set for that campaign.

A visitor is charged when our tracker records a real person reaching your page from one of the countries you chose, carrying the tag that identifies our campaign. Each person is counted once per day. We do not charge you for:

• visitors from countries you did not choose;
• crawlers, bots and automated traffic, which we drop;
• clicks we paid for where nobody arrived on your page;
• your own existing traffic, which never carries our campaign tag.

What the advertising costs us is our risk, not yours. If it costs us more than we expected, your price does not change.

Unused budget returns to your credit when a campaign ends. Credit does not expire while your account is open. Credit is for buying visitors and is not redeemable for cash, except that we will refund an unused balance on request if you close your account. Payments are processed by Stripe; we never see or hold your full card details.

If you have turned on automatic top-ups, we charge the card you saved, for the amount and never above the monthly cap you set, only when your credit falls below your chosen threshold. You can turn it off at any time.

5. Pausing and stopping

You can pause or stop any campaign yourself at any time, from your dashboard. Stopping ends the campaign and returns unused budget to your credit. Advertising platforms can take a short time to stop delivering after we ask them to, and visitors who arrive in that window are still counted normally.

We may pause a campaign without asking you first when doing so only reduces spending — for example when your budget is fully delivered. We will always tell you that we did.

6. What we do with your site

To run a campaign we read the page you give us, write advertising copy for it, and place that copy on advertising platforms. You grant us permission to use your name, logo and page content for that purpose, for as long as your campaigns run. You can ask us to stop using any particular wording and we will.

The advertising we create remains ours. You are welcome to ask us for a copy of the keywords and copy used in your campaigns.

7. Availability

We aim to keep Astern running but we do not promise it will be uninterrupted or error-free. We may change or withdraw features. If a change materially reduces what you have already paid for, we will tell you and refund the unused portion.

8. Ending the agreement

You may close your account at any time. We may suspend or close an account that breaches these terms, that puts our advertising accounts at risk, or where we are required to by an advertising platform or the law. If we close your account other than for a serious breach, we refund your unused credit.

9. Liability

Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Otherwise, and to the extent the law allows: Astern is provided as it is; we are not liable for lost profits, lost revenue, lost data or indirect losses; and our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose.

10. Changes to these terms

We may update these terms. If a change matters to you — pricing, how you are charged, or your rights — we will tell you by email before it takes effect. Continuing to use Astern after that means you accept the change.

11. Law and disputes

These terms are governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction, except that either of us may seek an injunction wherever necessary. If any part of these terms is unenforceable, the rest continues to apply.
